Substances to register

According to REACH chemicals comprise of:

All chemicals (phase-in and non phase in) manufactured or imported into the EU in quantities greater than 1 t per annum have to be registered at the ECHA. Some chemical substances are exempted from the general obligation to register. They include substances that are subjected to other regulations, waste, polymers etc.

Article means an object which during production is given a specific shape, surface or design which determines its function to a greater degree than does its chemical composition.

exempted

Substances exempted from REACH comprise:

  • substances that are subjected to other regulations, including:
    • food and food ingredients
    • medicinal products for human or veterinary use
    • radio-active substances
  • substances under customs supervision (in temporary storage, in transit, in a free zone on the EU territory while waiting to leave the EU)
  • non isolated intermediates (not intentionally removed from the equipment in which the synthesis takes place)
  • waste (from households: e.g. newspapers or clothes, food, cans or bottles; from professionals or industry: e.g. tires, slag, window frames that are discarded)
  • individual substances (according to Annex IV, such as:
    • some organics
    • cellulose pulp
  • categories of substances (according to Annex V), such as:
    • hydrates, providing the anhydrous form is registered
    • hydrogen, oxygen, nitrogen and the noble gases (argon, helium, neon, xenon)
    • minerals, ores, natural gas, crude oil, coal and coke
  • monomers bound into polymers (registration required if the monomer is present at ≥ 2% (w/w) in the polymer and is at ≥ 1 tonne per annum)
  • polymers (e.g. plastic materials, two-component glue)
  • certain recycled materials (exempt on the basis that their constituent substances will have already gone through REACH)
  • substances used in the interest of defence and covered by National exemptions
